Applicant requested records related to a complaint he filed approximately ten years ago against a municipal judge.  The previous complaint did not result in a public sanction or formal proceedings by the Commission.  We find that the records in the Commission=s investigative file are not judicial records for purposes of Rule 12, because they relate to the Commission=s adjudicative function.  Rule 12.2(d).  We also find that the records are confidential.  Rule 12.5(i).  See Rule 12 Committee Decisions 01-002, 01-005, 03-008, and 04-004.  Accordingly, we deny the appeal.
